Halifax County, NC - Will of Thomas Gardner - 1777

In the name of God Amen, I, Thomas Gardner, being very sick and weak of body but of sound mind and perfect memory, Praise God, do think fit to make and ordain this my last Will and Testament in manner and form following Vis:

 

First I recommend my soul to Almight God which gave it me helping through the merits of my ever blessed Saviour to receive a free pardon and remission of all my sins.

 

My body I commit to the earth to be decently Interred at the discretion of my Executors  hereafter named and as for my worldy estate which it hath pleased Almighty God to bestow upon me I leave as followeth

 

In Primis I give and bequeath to my three sons George, John, and Sterling Gardner all my Lands and will to be equally divided among them only my son Sterling to have my dwelling place and George to have the part in the road and John to have over the Marsh Swamp.  Also I give to my son George one Negro girl named Dinah.  Also I give to my son Sterling one Negro girl named Suca they and their increase to them and their heirs forever.

 

Item:  I give and bequeath to my son William Gardner one Negro boy named James also one Negro fellow named Harry to him and his heirs forever.

 

Item:  I give and bequeath to my son Camp Gardner one Negro boy named Bristoll and one ditto named Lewis to him and his heirs forever.

 

Item:  I give and bequeath to my son Thomas Gardner one Negro boy named Peter also one Negro woman named Winney she and her increase from this day (with the said Peter) to him and his heirs forever, also my lot in Winton.

 

Item:  I give and bequeath to my son Pryor Gardner one Negro fellow named Sam one Negro woman named Cate she and her increase from this day (with the said Sam) to him and his heirs forever.  My will and desire is that my beloved son William Gardner shall receive his said Negroes, I have above given him on the twenty fourth day of December 1773 and that the other children receive their Negroes above given them at the day of marriage or when they attain to the age of twenty one years and if either of my said children should die without heir lawfully begotten that their part shall be equally divided amongst the living.

 

Item:  I give all my other estate both royal and personal to be sold and the money equally divided among my seven sons Viz: William, John, George, Camp, Pryor, Thomas, and Sterling Gardner.

 

Lastly I appoint my beloved wife Martha Gardner and my son William Gardner and my son Sterling Gardner full, whole and sole executors of this my last will and testament revoking all other will in wills heretofore by me made and acknowledge this to be my last will and no other.  In witness whereof I have hereunto set my hand and seal this 9th day of November One Thousand Seven Hundred Seventy and Three.

We also suspect that there was a younger daughter named Delphia Gardner (married a Burgess) who was born abt 1790. The last will and testament of Pryor Gardner

 

State of Georgia    In the name of God Amen

Warren Co.            I Pryor Gardner of the State and County aforesaid being in reasonable health in mind and body but considering the uncertainty of this life do make the following my will and testament to wit

 

To God I commend my soul and my body to the earth in decent burial, and of my earthly estate

 

First I will and desire that all my just debts be paid

 

Second, Whereas Joseph Denson and Redding Lewis became security for Benjamin Sandeford together with myself by Bond to Andrew Stewart in a process of law in Warren County at the instance of said Andrew Stewart against said Benjamin Sandeford to make safe the said Andrew Stewart in a suit now pending in Warren Superior Court for the recovery of five hundred and eighty dollars eighty one and a quarter cents (or thereabouts) __________  interest wherein I. S. Barry is plaintiff and said Benajmin Sandeford and Andrew Stewart are defendants on a promissory note in which said Andrew Stewart is only security now if said Joseph Denson and Redding Lewis or either of them shall ultimately pay said debt or any part thereof in consequence of these said securityship then I will wish and desire that they and each of them or either of them be paid out of my estate the full sum of money they or either of them may pay with interest from the day they or either of them shall pay the same which when paid shall be considered as so much of the eight % ?? interest I may herein after give and bequeath to my Daughter

Martha Sandeford and which to be added to any sum and a like interest I may pay of said debt aforesaid.

 

Third  I have given my son William Gardner two Negro girls Hester and Teresa commonly called Creesy

 

Fourth  I have given my Daughter Sarah Powell formerly Sarah Harris one Negro girl Kesiah and I now give her ten dollars.

 

Fifth  I have given my Daughter Fannea Culpepper a Negro girl Lucy and I now give her a Negro man Jacob and an hundred dollars.

 

Sixth  I have given my son Elisha Gardner now deceased one Negro man Isaac.

 

Seventh  I have given my Daughter Sacky Rushing one Negro girl Rachel and I now give her a Negro boy named Adam.

 

Eighth  I give my grandson Pryor Gardner son of Sterling Gardner deceased a Negro woman named Hannah and her child Isabel which were delivered to Sterling Gardner his father but to return and become part of my estate if the said Pryor Gardner shall die before he is twenty years of age.

 

Ninth  I have given my Daughter Polly P. Heath two Negroes Sealy and her child Clara and I now give her a Negro girl named Louisa.

 

Tenth  I have given Elizabeth Veazey a Negro woman named Phoebe and her increase now two children Louisa and Rany with one other Negro girl Biddy and I now give her a Negro girl Mourning.

 

Eleventh  I have given my granddaughter Anna P. J. (or I) R. Veazey one Negro girl named Vilet.

 

Twelth   All the balance of my estate whether of goods - chattels lands or tenements of whatsoever name I wish sold and the proceeds equally divided between the ________ as follows:  Martha Sandeford William Gardner  Fannea Culpepper Sackey Rushing Polly P. Heath Elizabeth Veazey Sarah Harris (daughter of Sarah Powell) provided nothing herein contained shall be so construed as to give my daughter Martha Sandeford anything till the debt and interest aforesaid is paid out of that part that would

otherwise fall to her.

 

Thirteenth  I wish Henry Heath and John Veazey to execute this my last will as in other words I hereby nominate constitute and appoint Henry Heath and John Veazey executors of this my will and testament - hereby revoking all other wills by me made.

 

In testimony whereof I have hereunto set my hand and seal in presence of Mary R. Gibson Thomas Gibson and Obadiah C. Gibson who I have requested to attest the same as -

Codicil to the will of Pryor Gardner dated the first day of February 1827 made and executed after due deliberation as follows

 

(viz)  I give and bequeath to my daughter Elizabeth Veazey all the tract of land and improvements whereon I now live containing two hundred acres more or less on Long Creek adjoining the Lands of Jilson Berry and Asa McCrary together with all and singular the profits and improvements thereunto being or belonging to have and to hold forever provided she shall pay to my Executors six hundred dollars to be divided among the several persons named in the Twelth Item of my will to which this codicil

is annexed as prescribed in said Item.

          Upson County } I Sterling Gardner of the County & State aforesaid do make & ordain this my last Will & Testament hereby revoking all others.

 

          I direct that my body be buried in a decent & respectable manner, and that all my just debts be spioily paid.

          Item I give & bequeath to me beloved daughter Sarah Moss the sum of One hundred dollars, to her, her heirs & asignes forever.

William B. Gardner (occupation: farmer and religion: Presbysterian (Baptist)

 

John Gardner was born in 1778 in VA, lived at Beaver Creek, SC, then moved to GA in the 1830s in Monroe County where he owned a plantation and made all of his money off of cotton. When he died in 1860 he owned 14 slaves and 365 acres of land. On his tombstone it reads, "John GARDNER, BORN 1778 IN VA, ST. PETER SMILED, COME IN JOHN, KATIE IS WAITING." His wife was Catherine Pringle. They are buried at the Johnstonville Cemetery.

 

George Gardner was born in the 1770s or 1780s in VA or the Carolinas. I have found some George Gardners who fought in the South Carolina Militia during the War of 1812. George Gardner was arrested for assault & battery & disturbing the peace upon the body of William McGill, Jr. in Kershaw, South Carolina. George Gardner was bonded on September 3, 1822 for assault & battery. The event occured when George threw a chair at William McGill and threatened to kill him. William McGill, Jr. swore out a warrant for his arrest and charged him with assault & battery & disturbing the peace.

 

Leroy Gardner and Frank Cook found that in a criminal file, and it is more than likely our George Gardner, because our Gardners lived at Beaver Creek.

 

George Gardner's children were,

Daniel Gardner, who lived in Alabama.

John Gardner, who married Sykes sisters and lived in Alabama.

George Gardner, Jr., was a carpenter and was contracted to build the Union Primitive Baptist Church but failed to perform and the contract was taken.

Lewis Gardner, came to GA, divorced in MS, and died in TX.

Rebecca Gardner, married Ulyssess Parker.

Benjamin Gardner enlisted in CSA in May 1861 at the age of 27. He was present or accounted for through April 1864.  Company Muster roll April 30th-October 31st 1864 states he was wounded and in the hands of the enemy.  Provost Marshal records do not substantiate the report.  The company muster roll Nov.-Dec. 1864 states he died of wounds, date and place not reported.

SUMRALL/GARDNER: Interested in communicating with anyone researching the SUMRALL family of Marion Co., MS, or the GARDNER family of Amite Co., MS. Specifically, Elizabeth SUMRALL, b. abt. 1787 in Marion Co., died before 1831 in Amite Co. and William Henry GARDNER, b. 13 Feb 1781, Roanoke Rapids, Halifax Co., NC, d. 11 Oct 1840 Amite Co., MS. Elizabeth was William's second wife, bore him two children, Elisha Eugene (b. 1824) and Seaborn (b. 1827). Elisha Eugene GARDNER was my g.g.g. grandfather. By dates, it appears that she was in her mid-thirties when she married William, so this might well have been a second marriage for her as well. Elizabeth's parents were David SUMRALL and Sarah GIBSON; William's parents were Pryor GARDNER and Drucilla ROSE. I have some information on the ancestry of both families, and a bit more than that on the descendants of William and Elizabeth. Thanks.

Mrs. Francis Evans died at her residence in Thomasville, Georgia, January 13, 1861. She was born in Nash Co., North Carolina, May 12, 1789, and when young, her father Prior Gardner, removed to Warren County [near Augusta], in this state, and settled on a plantation on Long Creek, and there she was married to Nathan Culpepper in May 1806, who died after living with her twenty years. He left in her charge ten children, five sons and five daughters. She lived a widow twenty years. Her means were limited, yet she raised up all her children, and by industry and good economy, she provided well for their comfort and responsibility. Being a woman of good energy of character, she infused her spirit of industry into her children and did what is now-a-days too seldom done--taught them to work--made them self reliant. But that was not all; she moulded their moral and religious character at an early period, and nearly all of them are members of the church and respectable citizens. She was baptized by Joseph Roberts and became a member of the church at Long Creek in Warren County in 1828 or 1829. She loved the assembly of the saints and delighted in singing God's praises in religious meetings of her church. She had a fine voice for singing when young, and was not ashamed to employ it in the praise of God.

 

In the spring of 1848, our venerated brother Sterling Evans was married to her, and removed to Stewart County where they resided two or three years and removed to Thomasville. They preferred living in town, rather than on their plantation, that they might enjoy all the privileges of the church; but they are removed to the church triumphant.

 

A deeply interesting funeral discourse by Brother D. G. Daniel was delivered on the day of her interment, at the Baptist Meeting House in the town, to a very large and respected audience, and it will probably be published as requested.

Notes for Sterling Gardner CULPEPPER:

Sterling's parents died when he was a small child. On 4 Jun 1833, Sampson R. Culpepper was appointed guardian of Elizabeth, Nathan, Sterling and Drucilla P. Culpepper, orphans of Nathan Culpepper (Warren Co., Vol II, page 333). Sampson was their older brother. Sterling does not appear to have married. The middle initial in his name, "G" was most likely for Gardner, his mother's maiden name. His older brother Gardner also named a son, Sterling Gardner Culpepper,

and that Sterling Gardner was the first of four generations of Sterling Gardner Culpeppers (as of 1999). On 6 Dec 1843, S.R. Culpepper and Sterling G. Culpepper witnessed a deed, with John Harris, the seller; Robert Lazenby, deceased; Joel Cloud, buyer; and Sherwood Roberts Haden, adjoining landowner. In 1844 (exact date unknown), S.R. Culpepper and Sterling G. Culpepper witnessed two deeds: Each was a sale by John Harris to William Stone; in the first, Catherine Harris was deceased and Pierce Baily was an adjoining landowner; in the second George Harris was deceased. (Warren County Deed pages X336, X337, X340 and X341; from Warren Co., Col I, page

288) On 29 Nov 1845, Sterling G. Culpepper, S.R. Culpepper and Samuel Hall, Sr., witnessed the will Esther J. Wright, sister of Martha Sammons. (Warren Co., Vol II, page 170) According to the 1870 census, Sterling was then living in the household of his older brother, Sampson. On 6 Feb 1872, Sterling G. Culpepper sold 120 acres in Warren Co, GA, to Edwin A. Brinkley for $650 (Warren Co Deed Bk BB, page 307). Jesse M. Roberts, Nathan Pate, and John Busor were adjoining landowners; E.S. Cody and E.H. Pottle were witnesses. (Warren Co. I,

pg 396). On 7 Mar 1874, E.A. Brinkley sold land, previously owned by Thomas F. Persons, to J.F. Kinsey. There were seven adjoining landowners, including Sterling G. Culpepper. In Aug 1886, S.G. Amos Persons moved his family to Warren Co, GA between 1789 and 1798. He was not listed in the NC 1790 census. In 1798 he had purchased land in Warren Co, GA and in 1800 was appointed Justice of the Peace in Warren Co, GA.  Amos along with other brothers was listed in the Land Lottery of 1805. The 1810 census finds Amos and family living in Livingston Co, KY.

Lewis Gardner was born abt. 1810 in South Carolina. Tradition says that Lewis had a fall out with his father over a horse, and he came to Georgia where he married Martha Sykes and settled in Monroe and Pike Counties in Georgia on Sand Hill where he reared in agricultural pursuits near relatives. He then removed to Newton County, Mississippi abt. 1860. He divorced his wife on September 12, 1863 at her instigation, and he gave her all four hundred acres of land, a slave, and custody of the children. Lewis got slaves named Susannah, Ned, Henry, and a cook. He also got one said small sorrel mule, a saddle, a bridle, trunk, clothing, and debts due to him. He went to Texas during or after the Civil War and according to his son's bio, Lewis went to Texas where he lived in Houston County for a time, and then spent his last years in Johnson County, but family lore says that Lewis died in a gunfight with horse thieves at Natchez, Texas west of Brownsville near the King Ranch in the late 1870s.

 

Records of him, include, the 1850 Census in Pike County, Georgia, his membership of the Mt. Pleasant Baptist Church along with his wife from 1839-1841, and his divorce.

 

His occupation may have been horse trader in Texas.

 

There was also an attempted murderer named Lewis Gardner, and a horse thief named Gardner who was hanged. There was also a Lewis Gardner who was once arrested for a crime in Mississippi.

Lewis Gardner, my great great great grandfather, was born around 1810 at Kershaw County, South Carolina. His father was said to have been a Scotchman who died in Georgia, but it was believed that his father was John Gardner, and now it is believed that his father was George Gardner. The grandfather of Lewis Gardner was Daniel Gardner, who was possibly a "Regulator" in the Carolinas and had hailed from Virginia. Tradition says that Lewis left home after a fall out with his father over a horse and he, his uncle and cousins came to Georgia where they settled on Sand Hill in Monroe County. Lewis married Martha Ann Sykes around 1834 and he fathered thirteen known children who survived adulthood and became parents of their own. He was reared to agricultural pursuits, was a member of the Primitive Baptist Church and owned over two hundred acres of land. He moved to Pike County in 1845 and farmed until 1859 when he removed the family by mule wagon on the Natchez Trace in Mississippi. He purchased a four hundred acre farm in Newton County, with stock and slaves and his sons fought bravely for the Confederacy during the Civil War. Lewis and Martha Gardner divorced in 1863 and he gave her the farm, custody of the children, and fifteen year old Negro girl, along with stock. He got a saddle, a bridle, a trunk of clothing, a Negro girl named Susannah, a boy named Ned, a boy named Henry, a sorrel mule, and his belongings. Lewis was rumored to have remarried, possibly fathered a daughter, his second wife died, and he sold his place, abondoned his family and went to Texas, possibly because he killed a Negro right after the Civil War in 1865. He migrated to Texas where he lived in Houston County for time, where he possibly remarried around 1866 to Elizabeth Hale Box George, raising horses and cattle. His sons followed him and Lewis spent his last years in Johnson County, but family lore says that he went to south Texas where he was a bad man around Brownsville. He was said to have been a horse trader, a horse thief, a bigamist, and a lawbreaker who went to Texas to raise horses near the King Ranch. Lewis Gardner was said to have been good with a gun and a bad sort. He supposedly died in a gunfight with horse thieves at Natches, Texas while he was transporting horses to Louisiana to be sold, and he was ambushed. Lewis died well in to his sixties during the 1870's and was buried around Denton or near Burleson, Texas in the late 1870's.

Lewis was at first thought to be the son of "Old John" from Monroe County, but he was not mentioned in his will, aside from a light skinned black man named Lewis.

 

Daniel Gardner's sons:

Thomas Gardner, Sr., who was born around 1760 and enlisted in the 15th SC Regiment at Charleston and fought in the American Revolution. He came across a British vessel, which they commandeered and Gardner became the Captain. He was said to have had a slave named George, who claimed that Gardner had two twin steel flintlock pistols. Thomas Gardner, Sr. wrote a will in 1815.

 

William B. Gardner, who was a farmer in South Carolina. His son, Thomas Gardner fought in the Mexican War, and his son Jesse Gardner, fought in the Civil War as a Rebel Sgt., and they also had a Daniel W. Gardner, who wrote about his days during the Civil War in a quartermaster's regiment.

 

Daniel Gardner, probably served in the SC Artillery during the War of 1812 and died around 1819.

 

John Gardner, born in 1778 in VA, and married, fathered children, and lived and died a wealthy farmer in Georgia. He owned a 365 acre plantation and 14 slaves at the time of his death in 1860.

 

Lewis's father was probably George Gardner, who was charged with assault & battery in 1822.

 

Lewis Gardner was born around 1810 at Kershaw, South Carolina. He was the son of George Gardner, brother to "Old John" Gardner, who was at first thought to be his father, but the identity of who was Lewis Gardner's father is a mystery, just like his life and death. Tradition says that Lewis had a fall out with his father over a horse according to a letter, and that he came to Georgia around 1830, more than likely with his uncle "Old John" Gardner. They settled on Sand Hill in Monroe County and Lewis married Martha Ann Sykes around 1834, and fathered fourteen children, thirteen of which survived adulthood and became respectable citizens and parents of their own. He was reared to agricultural pursuits and owned over 200 acres of land while a member of the Primitive Baptist Church. Lewis moved to Pike County in 1845 where he farmed and in 1859 he removed to Newton County, Mississippi where he purchased a 400 acre farm, along with stock and slaves. His sons fought for their beloved Southland, and on September 12th, 1863, Lewis and Martha Gardner divorced. The story goes is that Lewis had been off somewhere and when he came back his wife gave him some lip and he got back on his horse and rode away. Lewis gave his wife the farm and custody of the children, while he got a Negro girl named Susannah, a boy named Ned, a boy named Henry, a sorrel mule, a saddle, a bridle, a trunk of clothing, and other belongings. He went to Texas during or after the Civil War around 1865 and lived in Houston County for a time, but spent his last years in Johnson County. Family lore says that he was on the Natchez Trace in Mississippi and had possibly been arrested for a crime, later being supposedly killed by horse thieves at Natchez, Texas near Brownsville or slain by a horse thief at Brownsville. He may have remarried and there is evidence that there was a Lewis Gardner in Houston County, Texas during the 1860's who had married Elizabeth George, the wealthy widow of Nelson Box, and there Lewis Gardner seemed to be a horse trader and cattle dealer around 1870. I have found a professional gambler named Gardner in Refugio County, Texas during the early 1870's, who did not have a first name. Rumors say Lewis Gardner was a horse thief and trader who was allegedly killed during a gunfight near the King Ranch, and was a badman, who drank, was tall, heavy set, sturdy build, big boned, white hair and long flowing beard, with faded blue eyes, and he had a rough, dangerous look about him. A family letter written by his great granddaughter in Georgia, hinted that he had been killed at Natchez, Texas, possibly Port Neches, Jefferson County, Texas. He died possibly during the 1870's, because his ex - wife, Martha Gardner was widowed on the 1880 Census living in Mississippi and later died in Bell County, Texas after deeding her youngest son, Joe Gardner, the family farm in 1878. Lewis's possible second wife was living in Navarro County, Texas on the 1880 Census as widowed. One thing for sure is that Lewis Gardner is a mystery.
